When does a company need to hire an environmental lawyer?
A company should hire an environmental lawyer when it receives an inspection or notice from the authorities; when a sanction proceeding is opened; when it needs to process an EIA or obtain an AAI; when it carries out an M&A transaction involving assets with potential environmental liability; when it is subject to Royal Decree 214/2025 or the CSRD; or when it installs, expands or transfers a facility with environmental impact.

Very serious environmental infringements can reach €2,000,000 under Law 26/2007 on Environmental Liability. Under the water regime (RDL 1/2001), fines for unauthorised discharges reach €1,000,000. Restoration measures, cessation of activity and disqualification may also be imposed.
